Term of Sale:
A deposit of 5% of the final contract price will be required to be paid to the Substitute Trustee, or his Sales Agent, in the form of cashier’s check, by the high bidder for each property sold on the sale date. If any prospective purchaser files an upset bid in accordance with Chapter 45 of the North Carolina General Statutes, he or she will be required to pay a deposit of 5% of the upset bid amount to the appropriate County Clerk of Court.
For Guilford County auctions, the deposit shall be made to and held by the Substitute Trustee, except for upset bid deposits which will be held by the Guilford County Clerk of Court until closing. In the event of a deposit forfeiture, the deposit shall be administered pursuant to North Carolina law.
Closing shall take place within fifteen (15) days after the auction, or within five (5) days after the upset bid period ends, whichever occurs first. Title will be conveyed by Trustee’s Deed.
