TERMS OF SALE:
1. FULL PAYMENT SHALL BE MADE ON DATE OF SALE AT THE CONCLUSION OF THE AUCTION.
2. TERMS OF SALE:
a. Payments by CASH, CREDIT CARD or CERTIFIED funds ONLY.
b. A 15% Buyer’s Fee will be charged on all items unless otherwise posted.
c. All sales are subject to state sales tax laws.
3. NO WARRANTY. The descriptions of items appearing in the Buyer’s Guide and in advertising prior to this sale are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by Owner or Auctioneer concerning any item shall be construed as a warranty, either express or implied. ITEMS ARE SOLD “AS IS-WHERE IS”.
4. RECEIPT. A Buyer will be furnished a receipt at the time of payment. The checkout person must authenticate this receipt before Buyer will be permitted to remove purchases from the sale premises.
5. REMOVAL DATE. Merchandise becomes the full responsibility of Buyer when the Auctioneer says “Sold”, and Buyer assumes all risk of loss and damage to property until removed from the sale premises. Buyer and Auctioneer agree that merchandise may remain on the sale premises for a period of time following the sale at the risk of the Buyer. The date by which all merchandise must be removed from the premises will be announced by Auctioneer at the sale and/or stated in writing in the Catalog. Bidder agrees to pay any storage charges assessed by Auctioneer on any item or items not removed by bidder by the removal deadline, or forfeit merchandise entirely, if premises are not available after designated removal period.
6. NO REFUND OR ADJUSTMENTS. Errors in estimate of merchandise inventory will be adjusted, but no adjustment will be made after merchandise has actually been removed from the location where it was sold or after the removal date announced by Auctioneer at the sale, whether or not the property has been removed. Management must authenticate all adjustments. No adjustments will be made for lost or stolen items.
7. RESALE. Auctioneer reserves the right to resell any property not paid for in full on sale day. The Buyer shall be responsible to Auctioneer for any expenses for resale and collection costs and any damages or shortages resulting from the resale.
8. INJURY AND DAMAGE. Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to hold Auctioneer harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.
Everything sells “As Is/Where Is.” Descriptions are believed to be correct, the auctioneer and owner make no warranties or guarantees, expressed or implied, as to the condition, authenticity of, or descriptions used in advertising. It is the sole responsibility of the bidder to verify these things prior to bidding. All bids and payments will be made in U.S. dollars and no refunds or adjustments will be made for lost or stolen items.
Absentee bids may be presented to the auctioneer in writing and must be paid in full within twenty-four (24) hours after notification of your winning bid. Said bids are subject to all terms and conditions of sale as listed herein or announced at the auction. All absentee bids will be held in confidence.
In default of payment of bills in full within the time announced for this auction the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for within the time specified herein may be resold at public or private sale without further notice. Any resulting deficiency together with all expenses and costs of re-sale will be the responsibility of the defaulting purchaser. Each buyer in making a bid does herewith agree to comply with the terms and conditions as herein stated and as otherwise set forth. The failure or default by a successful buyer to fully comply with the terms and conditions herein will be treated as an immediate breach. Any deposit made shall be retained and applied toward any deficit in additional costs or charges as incurred to affect the resale of that property at private or public sale. There shall be no further notice required to the buyer once default has occurred. The obligation of the buyer shall be for costs as incurred, plus any deficit included arising from the buyers’ default.
Removal of purchased items shall be at the expense, liability, and risk of the purchaser. No abandonment of purchased items is allowed. Purchaser will be responsible to pay the full cost of removal or disposal of abandoned items. Auctioneer shall not, in any event, be liable for non-removal or abandonment.
